A Blackhawk homeowner hired a contractor for a downstairs remodeling project that was performed negligently, causing a loss of support to the upper floor and resulting damage. MLF was retained by the homeowner to mediate with the responsible parties and recovered $150,000 in damages.
A Brentwood commercial building owner retained MLF when the contractor who built his 20,000 sf building refused to respond to persistent soils/foundation stress problems including wallboard cracks and out-of-level and cracking concrete slab floors. MLF litigated against the builder and other responsible parties and recovered $475,000 in damages for the client.
A large land developer and homebuilder retained MLF to defend it in a 109-home construction defect litigation, which ultimately settled entirely with funds from the developer’s liability insurance companies and contributions from responsible subcontractors and from another developer.
A large homebuilder retained MLF to defend it in a 29-home construction defect lawsuit. MLF negotiated a settlement whereby the homebuilder’s liability insurance company made a settlement payment to the homeowner class and the homebuilder assigned to the homeowner class its indemnity rights against responsible subcontractors. MLF’s client was not required to fund any portion of the class-action settlement.
A St. Helena property owner retained MLF to litigate against the general contractor who constructed his multi-million dollar vineyard estate when roofing deficiencies resulted in property damage in the main residence. The settlement of the lawsuit resulted in MLF’s client recovering $319,715 in damages.
A Lafayette homeowner retained MLF when his new home suffered foundation distress attributable to inadequate design of foundation footings and improper preparation of foundation soils. MLF filed a lawsuit against the homebuilder and the project soils engineer and recovered $240,000 in damages for the client.
